1. Introduction
These Terms & Conditions ("Terms") govern your use of the Proximity Map website and web application
located at proximitymap.io ("Service"), and all purchases of digital location reports
("Reports") made through the Service.
The Service is operated by ProximityMap.io, with its registered office at
Poland ("we", "us", "our").
By accessing the Service or placing an order you accept these Terms in full. If you disagree with any part,
please do not use the Service.
2. Definitions
- Report — a digital document generated automatically by the Service, containing an
analysis of Points of Interest (POI) around a location you select.
- User / You — any individual or legal entity using the Service.
- Order — a request to purchase one or more Reports via the checkout process.
- Account — a personal profile created when you make a purchase, linked to your email
address.
3. Service Description
Proximity Map allows you to explore Points of Interest around a chosen location for free. You can also
purchase premium Reports that provide deeper, AI-assisted location intelligence analysis.
Reports are generated automatically after a successful payment. They are delivered digitally — there is no
physical shipment involved.
4. Ordering & Payment
- To purchase a Report, select a location and a report tier, enter your email address, and complete the
checkout.
- All prices are displayed in US Dollars (USD) and include applicable taxes unless stated otherwise.
- Payments are processed securely by Stripe, Inc. We do not store your full credit card
details on our servers. Payment data is handled entirely by Stripe in compliance with PCI-DSS standards.
- A purchase is confirmed when Stripe notifies us of a successful charge. You will receive a confirmation
email with a link to your Report.
- You gain immediate access to your Report once the payment is completed.
5. Right of Withdrawal — Digital Content
⚠ Important — No Right of Withdrawal for Digital Products
Under EU Directive 2011/83/EU (Article 16(m)) and Polish Consumer Rights Act (Art. 38, point 13), you lose
the right to withdraw from a contract for the supply of digital content not supplied on a tangible medium
once performance has begun, provided that you gave your prior express consent and acknowledged the loss of
the withdrawal right.
Before completing checkout you will be asked to confirm that:
- You consent to the immediate delivery of the digital product (Report), and
- You acknowledge that by doing so, you waive your right to withdraw from the purchase.
If you do not grant this consent, we cannot begin generating your Report immediately. In
such a case contact us at contact@proximitymap.io to discuss delivery options.
6. Delivery of Digital Content
Reports are delivered exclusively in digital form:
- You receive a unique link to your report dashboard via email.
- You can view, explore, and download a PDF version of your Report from the dashboard.
- Reports remain accessible for a period of 12 months from the date
of purchase.
We are not responsible for delivery failures caused by incorrect email addresses provided by you.
7. Informational Nature & Limitation of Liability
ℹ Reports are for informational purposes only.
They are based on publicly available OpenStreetMap data and automated analysis. We do not guarantee the
accuracy, completeness, or timeliness of the information contained in any Report.
- Reports should not be treated as professional advice (real estate, legal, financial, or otherwise).
- We are not liable for any decisions, transactions, or actions you take based on
information in a Report.
- To the maximum extent permitted by law, our total liability to you for any claim arising from the
Service is limited to the amount you paid for the specific Report in question.
- We do not warrant uninterrupted or error-free operation of the Service.
8. Intellectual Property
All content on the Service — including text, graphics, interface design, code, and Reports — is owned by or
licensed to ProximityMap.io and is protected by copyright law.
- You may use purchased Reports for your personal or internal business purposes.
- You may not resell, redistribute, publicly share, or create derivative works from
Reports without our written consent.
- POI data is sourced from OpenStreetMap and is available under the Open Data Commons
Open Database License (ODbL).
9. User Obligations
You agree to:
- Provide a valid email address when purchasing a Report.
- Not attempt to reverse-engineer, scrape, or otherwise abuse the Service.
- Not use the Service for any illegal or unauthorized purpose.
- Not share your Report access link with unauthorized third parties.
10. Complaints
If you experience technical issues with your Report (e.g., it fails to generate, or is incomplete due to a
system error), please contact us within 14 days of purchase at
contact@proximitymap.io.
We will investigate and, if the complaint is justified, either re-generate the Report at no charge or issue a
refund.
11. Third-Party Services
The Service relies on the following third-party providers:
- Stripe — payment processing (Stripe Privacy Policy)
- Mapbox — map rendering and geocoding
- OpenStreetMap — POI data source
- Google Analytics — website analytics (see our Cookie
Policy)
We are not responsible for the practices or policies of third-party services.
12. Changes to These Terms
We may update these Terms from time to time. Changes take effect when published on this page. Your continued
use of the Service after changes are posted constitutes acceptance of the updated Terms.
For material changes we will attempt to notify active users by email.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved by the court
of competent jurisdiction for the registered office of ProximityMap.io.
If you are a consumer in the EU, you also have the right to use the EU Online Dispute Resolution
platform.
